Current Issue: Acquisition of an Improper Quality Car
Currently, the issue of the acquisition of an item of inadequate quality, usually a car, and the rights and obligations arising from it is particularly relevant.
Buyers, relying on not always honest sellers and being persuaded by them, purchase a seemingly well-maintained car, but over time the car begins to break down or was already damaged at the time of sale, but the defects are disguised so that the buyer does not notice them.
There are cases when the repair costs make up almost the entire price of the car.
Important to Know for Buyers
If you notice defects in the purchased car, you must immediately stop operating the car and contact the seller in writing.
A common mistake: Buyers repair the car, and only later decide to file a claim.
In accordance with the provisions of the Civil Code of the Republic of Lithuania, a buyer who has purchased an item of inadequate quality must first file a claim with the seller, who in turn can repair the item/car himself, reduce its price, and in the event of significant defects, there is a basis to demand termination of the purchase and sale agreement and return the item to the seller.
Why You Can't Repair It Yourself?
By deciding to repair the car yourself, the buyer often only worsens his procedural situation.
After repairing the car, it usually becomes objectively impossible to conduct an examination, assess the defects and the reasons for their occurrence, which increases the burden of proof for the buyer.
Therefore, in every case, qualified legal assistance is necessary from the very first step. This will allow for proper protection of violated rights.
Warning to Sellers
It is important to note that in practice, cases of dishonest buyers are constantly encountered, who, although they buy a used item, later make unfounded claims to the sellers in order to compensate for their expenses.
Important: In such cases, the entity selling the car should contact a professional lawyer from the very beginning, since this is the only way to properly protect against unfounded claims.
Individual Approach to Each Case
Each transaction of purchase and sale of a used or new item is individual, depending on the circumstances.
Only after familiarizing yourself with the actual circumstances of the transaction and the defects that have arisen during a personal legal consultation is it possible to provide advice that meets the specific case and predict the costs of litigation and the possible outcome.
